I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.

Compare the job duties (not just job titles) of the original and new job to determine if they are in the same Standard Occupational Classification (SOC). My EB2- I140 (INDIA) approved on March 09, 2007. We also have received our EAD last year after filing I-485 in July 2007.
I was checking online status and for my I-140, last updated date shows January 06, 2008. (My EB2 PD is OCT 2006). Can any one explain why the I-140 showing update date of 01/06/2008. The online status says following text :

Lawyers suggest renewing H1B as a backup in case 485 is denied. Having one more 140 or 485 is better than that. If he was going to get 2 GCs I would call it greediness, but one person is going to get only one GC and it doesnt howmany applications one person files. Moreover, people who file two applications are paying twice the money which will be used USCIS to increase capactiy. How about that?

I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.
Can anyone please help me with below queries
1. Do i need Original petetion from previous employer for Green Card processing ?.
2 Should i return H1 petetion or not to my previous employer ?.
2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.
I would really appreciate and thankful , if you clarify my doubts.

Hi,
I got an RFE on EAD Renewal and notice says the following.
The application you submitted must bear the original signature of the applicant. You must sign the attached copy of Form I-765 in the signature block marked in Red.
I got only RFE notice with this information and there is no attachment with this RFE.
I am 200% sure that I signed the application.
Now I have no idea what to do and there is no attachment to sign.
I filed myself without attorney help.
Any one please help me how to handle this RFE.
Can I send new I-765 application or request again for attachment
My EAD expiring on 8/26/2008

You might have signed using a black ink. Now-a-days, the photocopiers are so cool, you can not differentiate between original and a copy. It could be one of the reason, USCIS has sent an RFE on your EAD. Write a cover letter, Fill a new 765 form with the same details as the one you last sent and Remember to sign in BLUE ink.

when and how many times we have spoken to the IIO.
Like will a IIO be able to look at one's receipt# and say if they have spoken to an IIO earlier that day or whenever that is?

On 28 November 2008, "the United States" as defined for purposes of the Immigration & Nationality Act (INA) just got bigger, with the addition of the Commonwealth of the Northern Mariana Islands. Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:
Because the CNMI will become part of the "United States" as defined by �101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. Lately i noticed that my Date Of Birth is incorrect in page 5 of ETA 9089 Labor Form. This error is in section J Alien Information.
