Hello,

how is it possible to change jobs while the GC application is pending (part of the July 07 madness). Supposedly there is the AC21 form, is there an example how this form should be filled, and what other documents should be included? How long does it take to approve? (for driver's license, traveling, etc.). Does it have to be filed with H1B extension?

The new job offer is 25% pay increase, otherwise very similar, could that be a problem?

My wife had that stamped in blank passport an year and half back and had no issues...

She had all the documents

Copy of
my 797
my passport
my H1B visa
Proof of marriage
Letter from me stating I will support her and that she will live with me in US
My bank statements (last 3 months)
A letter of support from my employer

nothing else comes to mind at this time... All the best. Nothing to worry about.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.

1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.

2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?

3. If company A cancels the 140, still can I able to port the PD ?

If your I-140 is approved and dates not current you can get one time three years H1 extension. Otherwise one year extension is available.
Since your I-140 is approved You can port the priority dates even if Company A revokes the I-140

My case is filed in EB-2 although I am eligible to apply in EB-1.

When I filed, there was no retrogression for India, and so it made no sense to apply in EB-1.

Does anyone have any suggestions?

My PD is Dec 2004

and I have a 140 approved.

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.

Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?

I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.

I cant find anything on the net no this.

My father passed away recently and my mother wishes to travel with my wife and I on a visitor visa.

How can she apply for 10 year multiple entry visa? Can she return after the visa expires, after a month? Any experiences anyone can share? Are there any reasons why some visas get denied?

My wife and I are permanent residents and we want to know whether this is of any advantage/disadvantage.

Any pointers/info/help are much appreciated. I looked through the relevant IV threads and yes, they are informative but rules change all the time and I decided to just go ahead and post this thread to get the latest feedback.

Has your mother gotten US visitor visa before? The most important point is to prove to the consulate that your mom will return back from USA. To prove that you need to show some strong ties in your home country. Now that she is a widow it can work against her unless your siblings are still in india. All other things are secondary.
The number of years for the visa can range from 3 months to 10 years and it depends on how strong your mother's case is.
